Finding Criminal History
Some hiring managers become concerned when a
candidate has a history of suing a previous employer for problems at
the workplace, such as sexual harassment or unfair treatment. In
addition, when a company hires a candidate, that employee will have
some level of access to company assets. Therefore, it is important
for the company to decide whether the candidate is suited to the
type of work available. In today’s litigious society, employers
know that the choices they make today could be fodder for a lawsuit
tomorrow. Imagine the following scenario in a courtroom:
“Mr. Smith, you are the Human Resources manager
for XYZ Corporation, is that correct?”
“Yes, I am”
“And you were in fact the person who approved
Mr. Doe’s application for
employment?”
“Yes I am”
“What position did he apply for?”
“Delivery truck driver.”
“Did you do a background check?”
